HEALTH & SAFETY
1. The Client must complete the Coaching Waiver and/or New Client Pre-Exercise Questionnaire Form
provided by your Coach prior to commencement of any type of physical exercise.
2. The Client agrees their Health and Safety is their sole responsibility and will provide your Coach (The Apex
Coaching Academy) with all relevant medical conditions and injury information prior to undertaking
nutrition/exercise coaching.
REFUNDS
3. In order to honor the commitment of existing and future clients, the Company does not offer refunds. If
payments are not made on time, the Client agrees to pay interest on all past-due sums at a rate of 1.5% per
month, or the highest rate allowed by law, whichever is greater.
4. If the Coach is unable to perform the duties under this Agreement due to illness, emergency, fire, casualty,
strike, act of God, or causes beyond the control of the Coach, the Coach and the Client shall make every
attempt to reschedule the Session(s).
TERMINATION OF SERVICE AGREEMENT
5. The Client has the unilateral right to terminate the use and access to the Coaching Services. Please send an
email to brodie@apexcoachingacademy.com.au to initiate this process. The Client agrees that termination
will not excuse the Client of any further/outstanding payments owed to The Apex Coaching Academy
and/or Brodie Casa. Upon confirmation of termination, the Client agrees that any outstanding balances
remaining as outlined in the Fixed Term Agreement and Terms and Conditions 8 will become immediately
due and payable to The Apex Coaching Academy. Any outstanding balances that remain after 14 days from
the date of termination will be sent to a debt collections agency, and Client agrees to be responsible for any
additional charges, fees or costs associated with such a collection effort, including but not limited to
reasonable attorney’s fees and court costs and/or any other relevant collection costs.
COMMUNICATION
6. The Coach is available to provide Coaching Services during the hours of 9AM to 5PM in the Coach’s local
timezone, Monday through Friday. Any support provided outside of this time frame will be at the discretion
of the Coach. The Coach’s primary source of communication with the Client is through private messaging in
the Coaching Service application. The Coach will respond to the Client within 1 business day, or 2 business
days if documents are to be reviewed. The Client agrees and understands that the Coach may take holidays
and vacations off throughout the year. The Coach will notify the Client within 7 days of these time periods
and parties will work together to ensure all services are completed and/or scheduled for any time off.
SERVICE LOCATION
7. All parties (Client & Coach) agree that the coaching services outlined in this agreement will be provided
100% virtually.
RENEWAL/CANCELLATION
8. Once a client has completed the minimum term (in this case, 12 WEEKS), an automatic rollover to a
no-lock-in month-to-month agreement will be implemented effective immediately at the end of this fixed
term agreement, or the Client has the option to continue coaching for an additional 3 or 6 month fixed term
at a discounted rate which may be offered at the end of the fixed term agreement at the discretion of the
Coach. If the Client wishes to exit any coaching agreement at any time, the Client is subject to the 30-day
Notification Period (or 45 day Notification Period if opted in for a 6 month fixed term) whereby the Client
must notify the Company as soon as possible in writing stating they wish to cancel. Once written
confirmation of cancellation is received, the Client is subject to a 30 or 45 days cancellation period
(depending on term) whereby all payment terms and fees outlined in this agreement will continue over the
course of the 30-day (or 45-day) cancellation period. The Client understands renewal is not guaranteed and
is able to be terminated at any time by the Coach.
WARRANTY/GUARANTEES
9. The Services to be performed hereunder are Nutrition Coaching, Exercise Coaching (if applicable),
Education, and Guidance. The Apex Coaching Academy or any Coach herein does not warrant in any form
the results or achievements or the Services provided. The Coach/Company warrants the Services will be
performed in a professional manner in accordance with the generally accepted industry standards and
practices.
